how would students go about promoting an instructer to 5th drgree black belt.

Students promoting a Instructor, promotion is one belt at a time and it should be by the persons Instructor, who should be 2 ranks higher then them from how I learned it...
Is the Instructors Instructor not around?

Yes, basically students don't promote their instructors.  Instructors promote students.  At least that's the way it is in Kajukenbo.  In the K.S.D.I., a instructor can promote to 1 rank below their own.  Other Kajukenbo organizations require the instructor to be 2 ranks above the students they promote.
